Majority of the public has not critically digested and analyzed well the ingredients pertaining the whole story but let’s do it now:
1. The Student is a graduate of the January shift
2. She was at Makerere merely for her transcript
3. She had office Sex with a lecturer
4. She recorded part of the phases of the sexual encounter by way of phone pics
5. The recorded picture shows the lecturer completely vulnerable and in an oral activity usually intended for the female partner to getting stimulated to full enjoyment.
6. The whole scene exhibits the full aura of freedoms and choice between the parties.
7. There is not a single sign of a scuffle and all files in the somewhat compact office seem intact.
Now: What’s Sexual Harassment? The following have to be proved:- a. Un welcome Sexual advances b. Verbal or physical harassment c. Bullying or Coercion d. The harasser must have economic or social power over the victim.
Turning to the instant case, the most reasonable hypothesis indicates a graduate, doing nothing other than a visit to her former boyfriend.
Clearance of one’s transcript is not in the hands of any lecturer. It’s the subject of the Academic registrar at Senate building and once one graduate then by necessary implication all marks already left the lecturers docket and were captured by the registrar thereby graduating the student. At this stage the lecturer has no material obligations or even control over the aspirations of the graduate warranting forcible sexual demands.
This being a Staff at the department may however bring in the ingredient of influence over the victim but in the absence of all the above, sexual harassment isn’t largely probable. The jurisprudence of this offense is largely related to employee /employer relationship and establishing it in the subject case may sound frivolous and superfluous.
