The Ugandan government law on parental divorce and separation grants Rema Namakula right to move into her new marriage with daughter Aamaal Musuuza because she is aged below 7years to remain under her father’s custody.

WHAT IS CHILD CUSTODY:

Now before we delve into Child support, we need to understand what Child Custody is.

Under the law, Child Custody is the care, control, and maintenance of a child, which a court may award to one of the parents during a separation or when the parents are divorcing.

Courts can grant sole custody, where one parent is given exclusive custody of the child, and joint custody, where custody is shared between the parents.

WHAT IS CHILD SUPPORT:

During Custody, courts can also grant Maintenance Orders aka “Child Support”, in which one parent is ordered to contribute to the child’s upkeep. Usually, Child Support is requested by the Parent in custody of the child.

The amount to be paid is determined by the court and depends on what the other parent earns, and the needs of the child. If the other parent fails to pay up, then the court can force him/ her to comply.

The court can, for example, orders the Parent to pay up a monthly fee, which money might automatically be deducted from the person’s bank account.

WHAT HAPPENS IF ONE CANNOT PAY THIS MONEY ANYMORE:

During matters of child support, if one parent fails to pay up, then Court can issue certain orders to have this money recovered as though a Debt was being recovered.

However, if one cannot pay up e.g due to the loss of a job, then that person can go back to court to ask that the terms of the order be revised.
